# Renewing an attending contract

Any clause can change at renewal, and a renewal can bring an old covenant under a newer statute. This page lists what to compare and which clocks a renewal can restart.

**The decision:** Signing a renewed or amended employment contract.

## What changes

- Any clause can change at renewal. The renewal comparison opens the old and new versions in the browser and lists every clause that was changed, added or removed, without uploading either. ([Andwise: what changed in a renewal contract](https://www.joinandwise.com/contracts/renewal); checked 2026-10-21)
- Texas SB 1318 (2025) applies to physician covenants entered into or renewed on or after September 1, 2025; covenants entered into or renewed before then stay under prior law. A renewal can move an existing covenant under the newer statute. ([Tex. S.B. 1318 (89th Leg., R.S. 2025), enrolled text](https://capitol.texas.gov/tlodocs/89R/billtext/html/SB01318F.htm); [Andwise: Texas non-compete law](https://www.joinandwise.com/contracts/noncompete/texas); checked 2026-10-21)
- Fee-schedule changes reach a renewal's compensation terms: the 2026 efficiency adjustment cut work RVUs 2.5% for services that are not time-based. ([CMS, CY 2026 Medicare Physician Fee Schedule final rule fact sheet](https://www.cms.gov/newsroom/fact-sheets/calendar-year-cy-2026-medicare-physician-fee-schedule-final-rule-cms-1832-f); checked 2026-10-21)
- Deferred compensation in a non-governmental 457(b) plan, the kind a nonprofit employer offers, remains the employer's property and is subject to its general creditors until paid; the plan is limited to management or highly paid employees. A governmental 457(b) holds assets in trust for participants. ([IRS, non-governmental 457(b) deferred compensation plans](https://www.irs.gov/retirement-plans/non-governmental-457b-deferred-compensation-plans); [26 U.S.C. §457](https://www.law.cornell.edu/uscode/text/26/457); checked 2026-10-27)

## Who is paid for what

- **The employer.** Pays the contract's formula, which the renewal can change. ([Andwise: what changed in a renewal contract](https://www.joinandwise.com/contracts/renewal)) Not part of its role: Pointing out which terms changed between the old and new versions.

## Costs that come later

- A restated non-compete → Leaving the job, under the statute in force at renewal — https://www.joinandwise.com/contracts/noncompete
- Restated vesting, repayment or notice terms → Leaving within the new periods — https://www.joinandwise.com/contracts/renewal
- Deferrals into a non-governmental 457(b) → Leaving, when the plan pays out under its own distribution rules

## Deadlines

- The renewal or non-renewal notice date — Set in the contract

## Questions

### Counsel

- Does the renewal restate the non-compete, and does that change which statute applies?

### The employer

- Does the renewal restart any vesting, repayment or notice period?
- Which fee-schedule year does the renewed compensation clause use?
