Nevada physician non-compete law

As of October 21, 2026, Nevada has no statute specific to physician non-competes; general non-compete law and court decisions apply.

No physician-specific statuteChecked 2026-10-21

No physician-specific statute. Under NRS 613.195, noncompetes are void unless supported by valuable consideration, no broader than needed, not unduly harsh, and proportionate. They cannot bind hourly-only employees or bar serving unsolicited former clients, and courts must revise overbroad covenants. (Nev. Rev. Stat. § 613.195)

Limits in the law

  • Void as to employees paid solely on an hourly wage basis (NRS 613.195(3))
  • Cannot restrict serving a former customer or client who seeks out the employee without solicitation, if the employee otherwise complies with the covenant (NRS 613.195(2))
  • After a reduction in force, reorganization or similar restructuring, enforceable only while the employer pays salary, benefits or equivalent compensation such as severance (NRS 613.195(5))
  • Courts must revise unreasonable time, area or scope limits and enforce the covenant as revised (NRS 613.195(6))
  • Employee is awarded attorney fees and costs if the covenant covers an hourly employee or restricts unsolicited former clients (NRS 613.195(7))

Who it covers

Employer-employee noncompetition covenants generally, including physicians. There is no physician- or healthcare-specific provision.

Notes

NRS 613.195 last amended 2021. Two 2025 bills to bar noncompetes for patient-facing providers failed (SB 378 vetoed June 11, 2025; SB 495 not passed). No regular session in 2026.
